1. Introduction
These Terms of Service govern your use of the QuestPoint platform, including the venue management dashboard and visitor-facing trail experience, provided by QuestPoint Digital Ltd ("QuestPoint", "we", "us", "our").
By subscribing to QuestPoint, you ("the Venue", "you") agree to these terms. Please read them carefully before proceeding.
2. The Service
QuestPoint provides a software platform that enables visitor attractions to create, manage, and host GPS-triggered quiz trail experiences accessible to visitors via a web browser on their smartphone. The service includes:
• A venue management dashboard (the "CMS") for creating and managing trails, questions, locations, and branding
• A visitor-facing web application through which end visitors access and complete trails
• Hosting and infrastructure for all trail content and visitor data
• Analytics reporting on trail usage and visitor engagement
• Initial trail setup as included in your chosen plan
3. Subscription Plans
QuestPoint offers the following monthly subscription plans:
• Wanderer - £99 per month: 1 active trail, QuestPoint branding, basic analytics, first trail setup included
• Adventurer - £149 per month: 1 active trail, venue branding, full analytics dashboard, first trail setup included
• Pioneer - £249 per month: 3 active trails, venue branding, full analytics dashboard, all trail setups included
• Bespoke - for venues requiring more than 3 active trails, pricing by agreement
All plans include unlimited visitors and a 30-day free trial. No setup fee applies. Subscriptions are billed monthly.
4. Free Trial
All plans include a 30-day free trial period. During the trial, full platform access is provided at no charge. Payment details are collected at the point of sign-up but no charge is made until the trial period ends.
If you cancel before the end of the trial period, no charge will be made. Cancellation instructions are provided in Section 6.
5. Billing and Payment
Subscriptions are billed monthly in advance on the date your paid subscription begins (following the trial period). Payments are processed securely via Stripe. By subscribing, you authorise QuestPoint to charge your payment method on a recurring monthly basis.
All prices are in GBP and exclusive of VAT where applicable. QuestPoint reserves the right to update pricing with 30 days notice to existing subscribers.
6. Cancellation
You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No refunds are issued for the remaining days of a paid billing period.

7. Subscription Pause
Venues may pause their subscription once per 12-month period for up to 4 consecutive months. During a pause, no charges are made and the trail is suspended from visitor access. Your trail content, settings, and data are retained during the pause period.
To request a pause, contact [email protected] with your preferred pause start and end dates. Pauses must be requested at least 5 working days before the intended start date.
The subscription resumes automatically at the end of the pause period and billing recommences from that date.
8. Trail Data on Cancellation
Following cancellation, your trail content and associated data will be archived for a period of 12 months from the cancellation date.
If you wish to reinstate your subscription within this 12-month period and restore your archived trail data, a reinstatement fee of £199 applies in addition to the applicable monthly subscription.
After 12 months, archived data is permanently deleted and cannot be recovered. QuestPoint accepts no liability for data lost following this period.
9. Venue Responsibilities
As a venue, you are responsible for:
• Ensuring all trail content (questions, answers, images, and descriptions) is accurate, appropriate, and does not infringe third-party intellectual property rights
• Providing accurate GPS coordinates and location information for trail trigger points
• Ensuring visitors are made aware of the trail and how to access it
• Managing and distributing QR codes or access links to visitors appropriately
• Ensuring your use of the platform complies with all applicable laws and regulations
10. QuestPoint Responsibilities
QuestPoint will:
• Use reasonable endeavours to maintain platform availability and uptime
• Provide initial trail setup as included in your plan within an agreed timeframe
• Maintain the security and integrity of venue and visitor data
• Provide support via email at [email protected]
QuestPoint does not guarantee 100% uptime and accepts no liability for losses arising from temporary service interruptions.
11. Intellectual Property
All trail content you provide (questions, images, descriptions) remains your intellectual property. By uploading content to the platform, you grant QuestPoint a non-exclusive licence to host and display that content as part of the service.
The QuestPoint platform, software, branding, and all associated intellectual property remains the property of QuestPoint Digital Ltd.
12. Limitation of Liability
To the maximum extent permitted by law, QuestPoint's total liability to you in connection with the service shall not exceed the total subscription fees paid by you in the 3 months preceding the event giving rise to the claim.
QuestPoint accepts no liability for indirect, consequential, or special losses, including loss of revenue, loss of data, or loss of business opportunity.
13. Termination
QuestPoint reserves the right to suspend or terminate your account if you breach these terms, fail to make payment, or use the platform in a manner that is unlawful or harmful to others.
In the event of termination by QuestPoint for breach, no refund of subscription fees will be made.
14. Governing Law
These terms are governed by the laws of Scotland. Any disputes shall be subject to the exclusive jurisdiction of the Scottish courts.
15. Changes to These Terms
QuestPoint may update these terms from time to time. Where changes are material, we will notify you by email at least 30 days before they take effect. Continued use of the service following notification constitutes acceptance of the updated terms.

1. Introduction
QuestPoint Digital Ltd ("QuestPoint", "we", "us", "our") is committed to protecting the privacy of both the venues that use our platform and the visitors who participate in trails. This Privacy Policy explains what data we collect, why we collect it, how it is used, and your rights in relation to it.
This policy applies to questpoint.co.uk, questpoint.app, legal.questpoint.co.uk and manage.questpoint.co.uk.
2. Who We Are
QuestPoint Digital Ltd is the data controller for venue account data. For visitor trail data, QuestPoint acts as a data processor on behalf of the venue (the data controller).

3. Data We Collect
3.1 Venue account data
When a venue subscribes to QuestPoint, we collect:
• Name and contact details of the account holder
• Business name and address
• Email address used to create the account
• Payment information (processed and stored securely by Stripe - QuestPoint does not store card details)
• Trail content uploaded by the venue including questions, images, and location descriptions
3.2 Visitor data
When visitors participate in a trail, we collect:
• GPS location data - used solely to determine proximity to trail trigger points and is not stored beyond the active session
• Trail interaction data - which locations were triggered, questions answered, scores achieved, and time taken
• Device and browser information - used for analytics and to ensure compatibility
Visitors are not required to create an account, provide their name, or supply any personal contact details to use a trail.
3.3 Analytics data
We use Google Analytics 4 to understand how visitors and venue users interact with our platform. These tools may collect anonymised usage data including page views, session duration, and interaction patterns.
4. How We Use Data
Venue account data is used to:
• Provide and manage the QuestPoint subscription and platform access
• Process payments via Stripe
• Communicate regarding the service, including support and billing
• Provide analytics reports to the venue on trail performance
Visitor trail data is used to:
• Trigger trail locations as visitors move through the site
• Calculate and display scores at the end of a trail
• Provide aggregated analytics to the venue (no individual visitor is identified)
5. Legal Basis for Processing
For venue account data, our legal basis is contractual necessity - we process this data to deliver the service you have subscribed to.
For visitor data, our legal basis is legitimate interests - we process minimal data necessary to deliver the trail experience. Visitors are informed that GPS location access is required before the trail begins.
6. Data Sharing and Third Parties
We share data with the following third-party processors only to the extent necessary to provide the service:
• Supabase - database hosting and authentication (data stored within the EU)
• Stripe - payment processing (venues only; visitors make no payments through QuestPoint)
• Google Analytics 4 - anonymised usage analytics
We do not sell, rent, or otherwise share personal data with any third party for marketing or commercial purposes.
7. Data Retention
Venue account data is retained for the duration of the subscription and for up to 12 months following cancellation, after which it is permanently deleted.
Trail content uploaded by the venue is archived for 12 months following cancellation. After this period it is permanently deleted and cannot be recovered.
Visitor session data is retained in aggregated, anonymised form for analytics purposes. No individually identifiable visitor records are retained beyond the active trail session.
GPS location data is used in real time to trigger trail locations and is not stored.
8. Cookies
QuestPoint uses essential cookies to maintain session state and ensure the platform functions correctly. Analytics cookies are used by Google Analytics 4.
Visitors can manage cookie preferences through their browser settings.
9. Your Rights
Under UK GDPR, you have the following rights in relation to your personal data:
• The right to access the data we hold about you
• The right to correct inaccurate data
• The right to request deletion of your data
• The right to restrict or object to processing
• The right to data portability

10. Data Security
We take reasonable technical and organisational measures to protect personal data against unauthorised access, loss, or disclosure. All data is transmitted over HTTPS. Database access is restricted and authenticated.
In the event of a data breach that poses a risk to individuals, we will notify the relevant supervisory authority within 72 hours and affected parties without undue delay.
11. Children
QuestPoint trails are intended as family-friendly experiences. We do not knowingly collect personal data from children. Visitors under 13 should use the trail under parental supervision. No account creation or personal data submission is required from visitors to participate in a trail.
12. Changes to This Policy
We may update this Privacy Policy from time to time. Where changes are material, we will notify venue account holders by email. The current version is always available at privacy.questpoint.co.uk.
